Confidentiality
Unlike court hearings, mediation and arbitration sessions are private and entail a confidentiality clause enforced by law. According to section 42-A of the Arbitration & Conciliation Act 2019, all parties to an arbitration process are bound by law to maintain confidentiality of the proceedings. The mediator/arbitrator cannot be forced to disclose any information relating to the case nor disclose any views expressed by parties during the proceedings. All the proceedings are held in a private and closed set-up to provide our users/clients with an extra layer of confidentiality.
